AGREEMENT TO TERMS & CONDITIONS
Upon payment of a deposit you agree to be bound by the Terms and Conditions stated below. We reserve the right to refuse the sale of goods or services.
DEPOSIT
A 50% deposit is required to confirm a booking. No order is confirmed until a deposit has been paid & received. 
BALANCE DUE
The balance of payment is due 14 days prior to the date of the event. Orders will not be completed unless paid in full. 
If placing an order within that 14 day period, then full payment is due in order to proceed.
CANCELLATIONS/CHANGE OF DATE
All cancellations must be received in writing. If you cancel your order more than 14 days prior to the event, your deposit will be returned. If you cancel your order less than 14 days prior to the event, then the deposit will be forfeited. If your cancel you order less than 3 days prior to the event, then the full balance will be forfeited.
However, if Mirthia Cakes has to cancel the order with you for any particular reason due to health, family or situations out of our control, a full refund will be provided to you.
CHANGES
We ask that all changes are made in writing more than 7 days prior to the event. Please ensure that the invoice captures the correct details for the order.
REFUND POLICY
No refunds can be issued on orders that have been consumed or have been handled by the customer. No refunds can be issued after the order has left our premises or after delivery.
DELIVERY
Delivery may be arranged for an additional fee. We require an address to provide a quote. Cake deliveries will be made within reasonable business hours.
QUALITY
Mirthia Cakes bakes each order from scratch and tastes each element to ensure the highest quality. Please note that cakes need to be kept out at room temperature for at least an hour prior to serving. Mirthia Cakes cannot control changes in texture or changes in color or shape due to weather conditions. Where items are provided (plastic figures, toys or handmade sugared items), they are strictly provided as decoration and it is advised that these are not consumed. Some figurines and decorations may contain wire or toothpicks which are dangerous if consumed.
ALLERGY DISCLAIMER
All orders are made in a private residence in which nuts are used. Every effort is taken to keep ingredients separate however orders may contain traces of nuts.
DAMAGE
Mirthia Cakes takes no responsibility for any damage to the order after it has left our premises or after delivery.
PHOTOGRAPHS
Please be aware that all photographs taken prior to delivery remain property of Mirthia Cakes. Mirthia Cakes reserves the right to take and use photographs of your order to use for marketing, advertising, and promotional purposes, without compensation to you. 
VARIATIONS FROM PICTURED ITEMS
Please understand if a picture/image is supplied, then in some cases it may be necessary to change a colour or vary a product from the picture as certain items may be unavailable from time to time.
DISCLOSURE OF INFORMATION
Mirthia Cakes will not disclose any personal information such as your name, address, email or telephone number to any person outside of the company, unless the customer has authorised us to do so or unless required by law to disclose such information. Furthermore, under no circumstances will Mirthia Cakes sell or receive payments or services for disclosing customer’s personal information to any partner or external company.
LIMITATION OF LIABILITY 
IN NO EVENT WILL MIRTHIA CAKES BE LIABLE OR RESPONSIBLE TO YOU FOR ANY TYPE OF INCIDENTAL, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST REVENUE, LOST PROFITS, REPLACEMENT GOODS, LOSS OF USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER ARISING UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE.  IN NO EVENT SHALL MIRTHIA CAKES’ LIABILITY TO YOU EXCEED THE AMOUNT PAYABLE BY YOU UNDER THIS AGREEMENT, AND SHALL BE LIMITED TO DIRECT DAMAGES ONLY.
